Conditions of letting

Please note that incoming tenants may collect keys after 2.00pm on the day of arrival and departure is strictly 10.00am. Late departures may be arranged, but this is strictly subject to bookings (see condition 5). WE DO NOT ACCEPT CASH OR PERSONAL CHEQUES ON ARRIVAL.

Keys may be collected from our office located at Shop 1, 17-19 Stockton Street, Nelson Bay. Please note that our office hours are:
MONDAY TO SATURDAY 9.00am to 5.00pm
SUNDAY CLOSED
ALL PUBLIC HOLIDAYS CLOSED

* Please ensure you read the attached Conditions of Holiday Tenancy *

If an emergency or if you will be arriving after 5.00pm (OR IF YOU ARRIVE ON A DAY OUR OFFICE WILL BE CLOSED (see above)), an after hours service is available with Swans Security on for collecting keys. A fee of $20.00 is charged for this service and is payable on arrival to the security officer. The security officer cannot accept any monies on behalf of Century 21 so all monies due are to be paid before 5pm on the last business day prior to your booking. Keys cannot be given until all monies owed are paid.

The property you are to occupy has accommodation for NO more than 6 people maximum, and this number must not be exceeded. This includes adults and children 2 years old and over, cots must be provided for infants (hire available) (see clause 6.)

All of our properties are fully self contained with cooking facilities, Please note: All linen (sheets, towels, pillowcases etc.) soaps, detergents, and toilet paper are not supplied in the units but Linen Hire can be arranged at request, Television reception cannot be guaranteed due to poor signal reception in the general Port Stephens area. Gas bottles for the BBQ’s are not supplied. Contact Tomaree Linen Hire if your linen has not arrived.

The security deposit will be held until inspection of the premises upon vacation. If no damage has occurred, or no extra cleaning required, the deposit will be refunded by either a TRUST CHEQUE or by credit card (only if bond was paid by card), and posted to you within 7 working days in off peak seasons, and up to 14 days in holiday/peak seasons. If you lose your bond return cheque, or fail to receive it by post, we can cancel and re-issue the cheque at a fee of $15.00 which can be deducted from the bond. BONDS CAN NOT IN ANY CIRCUMSTANCES BE REFUNDED ON DAY OF DEPARTURE AND IS NOT AVAILABLE IN CASH.
Conditions of “Holiday Tenancy”

1. Reservation fee and security deposit: The security bond must be paid initially to secure the booking, if no payment is received 3 days after reservation Is made, the booking will lapse. Half of the rent amount is to be paid 13 weeks prior to arrival, or when booked if booking is made within 13 weeks of arrival.
2. Final Payment : The balance of the total tariff must be paid on arrival or by 5pm on the last business day prior or your balance may be charged to your account. Please note WE DO NOT ACCEPT CASH OR PERSONAL CHEQUES ON ARRIVAL.. Final payment by cheque must allow adequate time for clearance.
3. Refunds (less a $55 cancellation fee) are possible only if:
A) Notice of cancellation is made in writing more than 13 weeks prior to arrival date.
B) The property is rebooked for the full period.
* If neither of these conditions are met the total deposit paid will be forfeited.
4. Keys: Will not be made available until ALL monies have been paid in full. After hours collection of keys is available at a fee of $20.00 from Swans Security , (subject to change without notice). Keys are to be returned to our office on the day of departure, if our office is closed leave any swipe cards or remotes in the property and return the keys through the chute located on out office door. Occupants locked out of the premises requiring after hours assistance to gain entry, are required to call Swan Security on at a fee from $30.00 (subject to change without notice). Should you require a Locksmith call on or at a fee from $55.00 (subject to change). These fees are to be paid immediately. Do not contact security unless it is for after hours key collection or for EMERGENCIES ONLY, for any other issues please contact our office on during business hours.
5. Check-in and vacating times: Occupation commences from 2.00pm on the date of arrival, and the premises must be vacated by 10.00am, on the day of departure. A $50.00 PER HOUR PENALTY FEE will be charged for unauthorised late check-outs unless agreed upon prior with the office.
6. Number of persons: The number of occupants MUST NOT EXCEED the number agreed to with the agent at the time booking. A breach of this condition will permit the owner or agent to refuse a key, amend the rental, claim the bond or immediately terminate the tenancy (see clause 13 & 18).
7. The term: The premises are rented for holiday purposes only, for the term agreed upon with the agent.
8. NO PETS: Animals and pets are not allowed on or inside the premises, under any circumstances.
9. BOOKINGS ARE ACCEPTED BY US IN GOOD FAITH AS AGENTS FOR THE PROPERTY OWNERS: We cannot be held responsible for the actions taken by the owner of the premises or other occurrences that are outside of our control: Such as;
 The property being sold
 The tariff is increased prior to your occupation
 The property furnishings or decor altered in any way
 The property is withdrawn from letting etc.
Should this occur every reasonable endeavor will be made to find alternative accommodation.

Note: WE ACCEPT NO RESPONSIBILITY FOR THE MISDESCRIPTION OF THE PROPERTY, PARTICULARLY WITH REGARD TO TELEPHONE OR INTERNET BOOKINGS.

10. No Responsibility: is taken by the agent or the owners for tenants personal property.(also see point 11)
11. Breakages and Damages : As the tenant you are responsible for all damages and loss incurred during the term of your occupancy. These are to be reported or replaced and paid for immediately.
12. Cleaning: Please assist by leaving the premises clean and tidy. It is tenant responsibility to wash and put away any cutlery and cooking utensils, clean the BBQ and ensure the garbage bin is left out for collection at all times to ensure it is picked up. Any additional cleaning or garbage removal fees may be deducted from the security bond should property be left in an unsatisfactory condition.
13. Noise disturbance: Is a punishable offence by law and as such we reserve the right to immediately terminate the tenancy for any breach of this condition. A breach of any of the above conditions will permit the owner to refuse a key, amend the rental or immediately terminate the tenancy. No refunds will be paid on terminated tenancies.
14. Properties For Sale: In the event of the property being offered for sale, the tenant agrees to allow the owner or agent to inspect the property with prospective purchasers during reasonable hours by appointment.
15. Repairs: The tenant agrees to allow the agent or a representative to enter the rented premises to arrange necessary repairs.
16. Forgotten Items: If any items are left in the property after vacating and it is not possible for the tenant or someone on behalf of the tenant to return and collect the items, postage can be arranged at a cost of $15.00 + the cost of postage (varies depending on destination).
17. Smoking: Please be advised that all properties are strictly non-smoking.
18. Breach of Conditions: Please be aware if any of the above conditions are breached all costs incurred will be withheld from the security bond and the remainder will be returned.

  • "Apartment was very clean, modern and spacious with all creature comforts. Location was excellent with slight water views off the main balcony.The only drawbacks with this property were no bbq ( though displayed on the picture) and due to its proximity to a major roundabout, there was some traffic noise.Otherwise, it was a lovely place to stay and we would highly recommend it to others !"
