Terms and Conditions of Holiday Tenancy
1.THE PERSON MAKING THE BOOKING - must stay in the property and will be held responsible for the conduct of all guests. The premises are let to you for holiday purposes, only for the period stated on the final receipt and for the maximum persons per bed as agreed with the agent at the time of booking. Exceeding maximum numbers will permit the agent to refuse a key, amend the rental or immediately terminate the booking.
2.CHECK IN & VACATING TIMES - The premises are available from 2:00pm (or 3:00pm for Christmas bookings) on the day of arrival and are to be vacated no later than 10:00am on the day of departure (9:00am for December/January Holidays). A fee will be charged for any late check outs.
3.RESERVATION FEE - The reservation fee is to be paid within 24 hours of booking. The reservation fee is part of the total tariff payable and must be a minimum of $200.00. Non-payment of this deposit will be deemed a cancellation of the booking.
4.HOLIDAY BOOKING FEE – A $30.00 booking fee applies to all holiday bookings and is non-refundable.
5.EASTER & CHRISTMAS BOOKINGS – 50% of the balance of your booking is due 6 months prior to your arrival date. Failure to do so will be considered a cancellation of the booking. No reminders will be issued.
6.FURTHER BOOKING PAYMENT – A further payment will be required of up to 50% of your booking total when you are booking in advance. The payment amount required and payment due date will be specified on your confirmation letter.
7.FINAL PAYMENT - The balance of booking must be paid 14 days prior to arrival (or 30 days prior to arrival for any Easter and Christmas period bookings and all school holidays and special events such as Gromfest). Failure to do so will be considered a cancellation of the booking. No reminders will be issued. Please note Lennox Head Professionals are a cashless office.
8.BOOKING PAYMENTS – Due to our booking system, we will require three payments only for all bookings (reservation fee, further payment and final payment). Please contact one of our holiday staff to discuss.
9.FULL PAYMENT - Bookings made within one month of arrival require full payment on booking.
10.CREDIT CARD FEE - When paying by credit card, a card fee of 1.76% will be payable for Visa, Mastercard and AMEX. Please be aware that these figures may change without prior notification.
11.KEYS - Keys will not be made available until all monies have been paid in full. Arrangements for the collection of keys after office hours should be made prior to arrival. An after hours call out fee of $50.00 will apply to any guest that locks themselves out of the property and must be paid within 24 hours.
12.SECURITY BOND – A bond of $500 - $1000 will be required on or before arrival. This is undertaken by way of credit card authorisation form. The security bond will be held until inspection after the premises are vacated. Funds will be deducted from the security bond if we need to make a claim which may include, excess cleaning fees, damage or breakages, excess garbage removal, late check out, telephone calls (if applicable).
13.BREAKAGES & DAMAGES - All damages, breakages or losses to the property, furniture and furnishings are to be reported to the agent and paid for by the guest immediately. Loss of a restricted key will incur the cost of $30.00 and the loss of a remote control $70.00.
14.WINDOWS & DOORS – Please ensure that you secure and lock all windows and doors when not in premises. Any damage caused by failing to do so may result in re-imbursement to our office for any associated costs.

15.CANCELLATION – A cancellation fee of $130 will apply under ANY and ALL circumstances.
i) If the property is re - let for the total period formerly booked by you, the cancellation fee only will be
charged and the balance refunded.
ii) If the property is not re - let for the total period formerly booked by you, ½ the tariff for the period
not rebooked will be charged the exception being Christmas, Easter, School Holidays or Special
Events when the full tariff will be charged.
16.THE BOOKING IS MADE IN GOOD FAITH BY OUR OFFICE AND MAY BE SUBJECT TO CHANGE. While we cannot be held responsible for actions taken by the owners of the premises or other occurrences that are outside our control, we will endeavour to assist you or find alternate accommodation when necessary. Tariffs are reassessed annually.
17.SALE OF PROPERTY – The agent cannot be held responsible should a property be sold and the
booking cancelled.
18.WE ARE CAREFUL NOT TO MISREPRESENT ANY RENTAL PROPERTY. No refund is given if you are unsatisfied with your accommodation. No provision can or will be made for relocation if accommodation is deemed unsatisfactory on arrival other than on the basis that the full rental due be forfeited and full rental on new premises is paid prior to occupancy.
19.PETS - Pets are not permitted on or inside the premises, under any circumstances. A breach of this condition will result in termination of your booking. No refund will be paid on terminated tenancies.
20.PERSONAL BELONGINGS - No responsibility is taken by the agents or the owners for guest’s personal property left on the premises.
21.REPAIRS - The agent endeavours to have any repairs to appliances attended to as soon as possible after reporting same. However due to unforeseen circumstances (eg. Having to order parts or non availability of trades people) the immediate repair may be beyond our control. No responsibility is accepted by the agent for these unforeseen circumstances. There will be no refunds or discounts deducted from tariffs for unusable appliances awaiting repair.
22.CLEANING – Please assist by leaving the premises clean and tidy, with cutlery and cooking utensils washed and put away, or additional cleaning fees will be charged. If, upon occupation, the property or contents fail to meet acceptable cleaning standards every endeavour will be made to rectify the problem. However, this shall not be grounds for cancellation or refund.
23.BBQ – Please assist by leaving bbq clean and tidy or an additional cleaning fee of $25.00 will be charged.
24.PRIVATE FUNCTIONS – No private functions are to be held at rental properties. Premises for holiday purposes only.
25.STRATA TITLE LAWS – Strata title law must be observed, you are in a residential area and regard must be paid to the quiet enjoyment of other occupants in the building and the neighbouring properties.
26.NOISE – Noise pollution is a punishable offence by law and as such we reserve the right to immediately terminate the tenancy without refund for any breach of this condition.
27.CONSTRUCTION WORK – This office will not be held responsible for any noise from construction work occurring close to holiday properties and any noise shall not be grounds for cancellation or refund.
28.LINEN HIRE - All properties are let without linen unless you are advised otherwise. Where linen is not provided, it can be hired from Byron Bay Linen Hire (02) 6685 6247. You will need sheets, pillow cases, towels and tea towels.
29.ROLLOVER BOOKINGS – Options apply to only the day/week of the calendar month and does not move with the holidays. It is your responsibility to check dates prior to re-booking. A reservation fee of $200.00 is required on re-booking with 50% of the balance due 6 months prior to arrival.
PLEASE NOTE - A breach of any of the above conditions will permit the owner to refuse a key, amend the rental or immediately terminate the tenancy. No refunds will be paid on terminated tenancies.
