HOUSE RULES:
1. AUTHORIZED USE AND GUESTS: The Premises are for the sole use as a personal short-term residence by not exceeding the county-specified occupancy limit for your specific rental.
2. PARKING: No street parking is allowed at any time and the number of vehicles allowed is set by the county and may not exceed that amount AND CAN IMPOSE A FINE THAT IS RESPONSIBILITY OF THE GUEST. Min $1000
PLEASE READ: THE COUNTY IS VERY STRICT ABOUT THE MAXIMUM NUMBER OF OCCUPANTS IN THE HOME AND THE NUMBER OF VEHICLES ON THE PROPERTY. IF WE FIND MORE OCCUPANTS OR VEHICLES THAN ALLOWED BY THE COUNTY THERE WILL BE A FINE AND WILL BE ASKED TO LEAVE.
3. PETS ARE NOT PERMITTED UNLESS APPROVED BY MANAGEMENT WITH AN ADDITIONAL PET FEE IF THE HOME ALLOWS PETS. IF AN UNAUTHORIZED PET IS FOUND IN THE HOME IT WILL BE ASKED TO LEAVE. Pet owners be aware of wild animals and do not let your animals roam free or unattended outside. There is a leash law of 6ft maximum required by the county. Coyotes, Bears, Mountain Lions, and bobcats are known predators in the area. IF WE FIND AN UNAUTHORIZED PET IN THE HOME THERE WILL BE AN ADDITIONAL FEE OF $250.
4. PAYMENTS: All Rent, Cleaning Fees, Taxes, and deposits are to be paid before arrival. If booking through a third-party website their rules apply.
5. SECURITY DEPOSIT: All security deposit holds of $500 will be collected two days before check-out and the hold will be removed seven days after check-out and are 100% refundable with no incidents. Please note this DOES NOT apply to all booking platforms. Please ask if you have any questions.
6. REFUNDS: Refunds will not be given due to snow or inclement weather, we will allow the occupant/guest to reschedule with no additional fees with the same rent or less. If the rent is higher than the original amount occupant/guest must pay the difference. Natural Disasters or the inability to travel due to natural disasters or other extreme government-enforced situations, occupant/guest to reschedule within 30 days from the original reservation.
7. HOLDING OVER: Occupant and guests agree there shall be no holding over or late departure without prior approval from management. Any unauthorized holding over by occupant/guest shall be subject to 1 and 1⁄2 times the daily prorated rent, plus any additional damages incurred including, but not limited to, the cost of alternative housing for guests displaced by occupant’s holding over.
8. CLEANING: Premises will be delivered to the occupant in a professionally cleaned condition. Upon check-out, the occupants will follow all check-out instructions found in the House Manual. If Occupant does not follow check-out instructions, they may be subject to additional cleaning fees.
9. NO SMOKING/DRUG USE ALLOWED: No smoking is allowed on the Premises; this includes but is not limited to; marijuana, cigarettes, cigars, or any other drug legal or not. If smoking does occur on the Premises, the occupant is responsible for all damage caused by smoking including, but not limited to, stains, burns, odors, or removal of debris. Occupants/guests may be required to immediately leave the premises. IF WE SMELL SMOKE IN THE HOME FROM ANY OF THE ABOVE-LISTED ITEMS THERE WILL BE A $1000 FEE.
10. CONDITION OF PREMISES: The occupant has not viewed the Premises before entering into this Agreement. Occupant shall, upon arrival, examine the premises, all furniture, furnishings, appliances, fixtures, and landscaping, if any, and shall immediately report, in writing, if any are not in operating condition or are in disrepair. Reporting repairs does not give the occupant the right to cancel this agreement or receive a refund of any payments made. The Dogwood cabins cannot guarantee the working conditions of but are not limited to, spas, cable/satellite, or WIFI/Internet, as inclement weather may disrupt these services.
11. ALTERATIONS TO PROPERTY: Occupant shall not make any alterations, in or about the premises including, but not limited to, moving furniture, painting, wallpapering, adding or changing locks, installing an antenna or satellite dish(es), placing signs, displays or exhibits, or using screws, fastening devices, large nails or adhesive materials.
12. NO ASSIGNMENT OR SUBLETTING: The occupant shall not assign any interest in this agreement or sublet any part of the premises. If this agreement is assigned or the premises or any part thereof is sublet, the occupant, authorized guests, assignee(s), sublessee(s) and all others may be required to immediately leave the premises or be removed from it. The occupant is in breach of this agreement, and the occupant forfeits its right to the security deposit.
13. UNAVAILABILITY: If for any reason beyond the control of The Dogwood Cabins, the Premises is unavailable, The Dogwood Cabins may substitute a comparable unit or cancel this agreement and refund in full to the occupant all payments made.
14. ENTRY: The Dogwood cabins and agents have the right to enter the premises at any time, for the purpose of making necessary or agreed repairs, for maintenance or to supply necessary or agreed services, to verify that the occupant/guest has complied with the terms of this Agreement, or in case of emergency.
15. INDEMNITY AND HOLD HARMLESS: The occupant agrees to indemnify, defend, and hold harmless the owner and The Dogwood Cabins from all claims, disputes, litigation, judgments, costs, and attorney fees resulting from loss, damage, or injury to the occupant, Occupant’s guests or licensees or their personal property.
16. MEDIATION: Occupant agrees to mediate any dispute or claim arising out of this agreement, or any resulting transaction, before resorting to arbitration or court action. mediation fees, if any, shall be divided equally among the parties involved.
17. TRANSIENT OCCUPANCY: The occupant is renting the premises as a transient lodger for the number of days specified in line 4 from the owner who retains full legal, possessory, and access rights.
18. COUNTY CODES: The occupant agrees to follow all County Short-Term Rental requirements. Failure to comply with the requirements of this chapter, County Code Condition of Operation 84.28.070, including parking and occupancy standards, as well as public and private nuisance standards, violates the County Code, and such violation may result in enforcement actions to address the violation. These may include actions to abate the nonconformity, the institution of criminal, civil, or administrative actions, or, under certain circumstances, the calling of law enforcement for the removal of guests and their vehicles from the property to the extent authorized by law. The notification shall state in a prominent format that users of the unit are prohibited from disturbing the peace of the surrounding neighborhood that doing so is a violation of this chapter and that guest will pay any to all county fines.
19. VIDEO SURVEILLANCE: Video and recording devices may be located outside the property. Cameras will never look into the home. For specific information on your rental property contact management.
20. WEATHER ADVISORY: WE RECOMMEND CARRYING CHAINS WITH TENSIONERS FOR YOUR SPECIFIC VEHICLE AND TIRE SIZE DURING THE WINTER MONTHS OR ANY POSSIBILITY OF SNOW. CalTrans WILL HAVE CHAIN CHECKS AND MAY NOT ALLOW ENTRY ON THE MOUNTAIN WITHOUT THEM. PLEASE BE AWARE DURING INCLEMENT WEATHER (THIS INCLUDES SNOW, HIGH WINDS, HEAVY RAINS, FREEZING CONDITIONS ETC.) THERE MAY BE POWER FAILURES FOR EXTENDED PERIODS. THIS IS OUT OF OUR CONTROL AND REFUNDS WILL NOT BE ISSUED.
21. QUIET HOURS: Guests are required to abide by county quiet hours, Sunday through Thursday 9 pm to 8 am, and Friday to Saturday 10 pm to 8 am. Please keep all music and noise inside during this time.
22. DIRECT BOOKINGS: When booking directly with The Dogwood Cabins a deposit of 25% may be required to hold guests desired dates. This includes deposits, cleaning, and all other fees, rent, and taxes.
23. ITEMS LEFT BEHIND: Make sure you have all your personal belongings with you upon departure. We will not mail items left behind.
24. AGREEMENT: Occupant agrees to above all policies when booking is confirmed.
