Life vests are not provided and are mandatory to use kayaks. (Must sign separate agreement).
Kayaks Free Rentals
Renters and guests may use the kayaks at 801 Pequot Ave., New London, Ct. on the following
conditions.
1. Renters and their guests must be over 21 years old. Guests younger than 21 but older than 16 may use the kayak with adult supervision.
2. Life jackets are Not provided and are mandatory must bring your own .All renters and guests must sign damage and waiver agreements prior to using the kayaks. See below.
3. Security deposit of $400.00 is required in the event damage including loss of paddles.
4. Use of kayaks are under your own risk.
The renter(s) agree that any claims against the landlord, their relatives, spouse
and all living or dead relatives. regarding the rental of property shall waive any
and all lawsuits in State, Federal Courts or any other legally American
jurisdictions and shall be subject to Arbitration.
By agreeing to arbitration, the parties understand and agree that they are waiving their
rights to maintain other available resolution processes, such as a court action or
administrative proceeding, to settle their disputes; and
• Instead of suing in court, we each agree to settle disputes only by arbitration.
Any dispute, claim, or grievance arising from or relating to the interpretation or
application of this agreement shall be submitted to arbitration administered by the
American Arbitration Association under its Labor Arbitration Rules. The aggrieved party shall notify the owner of the claim within thirty (30) days of the alleged violation. If a dispute arises out of or relates to this contract, or the breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association. If the parties are unable to come to a settlement, the aggrieved party may file the dispute with the American Arbitration Association (AAA) located in Hartford, Connecticut. Within ten calendar days after the arbitration demand is served on the respondent, the parties must jointly select an arbitrator . If the parties do not agree on an arbitrator within ten calendar days, a party may petition the agency whose rules govern the arbitration to request a list of arbitrators and select one under the agency’s rules. The initial filing cost shall be borne by the aggrieved party. The final arbitration cost shall be shared by both parties. The sole remedy will be actual damages; no
punitive damages are allowed. The parties further agree to accept the arbitrator’s award as final and binding on them.
