This property has special local compliance requirements which include a signed rental agreement, ID verification, and a security hold of $1500 (which is not a traditional security deposit, just a pending transaction). As an optional alternative to the security hold, you may opt in to purchase a non-refundable damage waiver provided by a third-party insurance company. The optional damage waiver is $59 for stays up to 9 nights, with an additional $3 per day for stays longer than 9 nights. Damage waiver purchases are optional.

To make this process easy for you, we use a secure and very simple, app-free platform called Happy Guest. It is not an app, and you do not have to sign up for an account - it’s a safe and secure website. It also gives you a guest portal with all the info about the home and all of my favorite local spots.

1. LIMITED OCCUPANCY:
Occupancy is limited to a maximum of 16 individuals. With Owner approval, up to 22 guests (additional fees apply per guest over 16). If the Owner determines this policy has been violated, the Owner reserves the right to expel the entire party without refund.


2. TRANSIENT OCCUPANCY — NO TENANCY CREATED:
This property is a transient vacation rental. It is not the Guest’s residence, domicile, or dwelling.

No landlord-tenant relationship. The Guest is a transient occupant and licensee only. Nothing in this Agreement creates a tenancy, lease, leasehold interest, or landlord-tenant relationship between the Guest and the Owner, and the Guest acquires no rights, remedies, or protections afforded to residential tenants under the Texas Property Code or any other landlord-tenant statute. The Guest is granted a limited, revocable license to occupy the property solely for the reserved dates.

Extended stays. Reservations of 30 or more consecutive nights may be accepted at the Owner’s sole discretion, including for work crews and corporate bookings. Occupancy remains transient regardless of the length of the stay, and no reservation of any duration converts the Guest’s limited license into a tenancy, lease, or leasehold interest.

Guest representation. The Guest represents and warrants that the property is not, and will not become, the Guest’s primary residence, permanent address, or legal domicile.

No possession. The Owner retains full legal possession and control of the property at all times and reserves the right to enter for inspection, maintenance, safety, or to verify compliance with this Agreement. Access codes and keys convey a license to enter, not possession.

Holdover. The Guest’s right to occupy terminates automatically at the check-out time on the departure date. Any Guest or occupant who remains on the property after that time without the Owner’s prior written consent is an unauthorized occupant and trespasser, and the Owner may pursue immediate removal by all lawful means, including contacting law enforcement. A holdover Guest agrees to pay liquidated damages of $1,000.00 per day, or the property’s prevailing nightly rate, whichever is greater, plus all costs of removal, including attorney’s fees, court costs, locksmith charges, and compensation for any bookings the Owner is forced to cancel or relocate.


3. NON-DISTURBANCE CLAUSE:
Renter and their guests shall not disturb, annoy, endanger, or create inconvenience for neighbors, nor shall they use the premises for any unlawful purposes.
Fireworks are strictly prohibited on the property and surrounding grounds at all times, regardless of local ordinance. If you or your guests are using fireworks, you will be evicted from the property with no refund, and the authorities will be called.


4. CARE OF PREMISES/DAMAGES:
NO PETS ALLOWED

No animals are permitted except for service animals. ESA’s are not considered service animals under federal law. If a pet is brought other than a service animal, there will be a non-refundable fee assessed to your reservation of $1,500.00, and/or your stay will be forfeited, and no refunds will be given.

NO SMOKING OR VAPING PERMITTED IN THE HOUSE.

Any violation will result in automatic eviction and forfeiture of both the deposit and rent.

The Renter agrees to compensate the Owner for any damages to the property, furnishings, appliances, or household items that occur during their stay.
The Renter further agrees to reimburse the Owner for the full cost of any cleaning required beyond standard turnover cleaning as a result of the Renter’s occupancy.


5. OWNER’S RIGHTS:
If the conditions and limitations of this agreement are not met, the Owner reserves the right to cancel the agreement and may enter the property by statutory proceedings or force to inspect the property and ensure the Renter has vacated. All payments made by the Renter shall be forfeited as liquidated damages.


6. INDEMNITY CLAUSE:
The Renter agrees to indemnify and hold the Owner harmless from all claims, including those from third parties, arising from or related to Renter’s use of the property or any personal property provided. The Renter assumes all risks of injury or loss related to any recreational activities on or about the premises, including use of the hot tub, and will hold the Owner harmless.


7. NO SUBLETTING:
The Renter may not sublet or assign this lease, in whole or part, without the prior written consent of the Owner.


8. REPAIRS AND MAINTENANCE:
The property is rented with the Owner’s furniture and furnishings. The Owner is not responsible for providing additional furnishings or equipment. The Renter must report any maintenance issues immediately.

9. CANCELLATIONS:
We understand that plans can change. Please review our cancellation policy below:
• Full Refund: Guests may cancel for a full refund if the cancellation is made at least 30 days prior to the check-in date.
• Grace Period: Guests who cancel within 48 hours of booking are eligible for a full refund, provided the cancellation occurs at least 14 days before check-in.
• Partial Refund: Cancellations made between 7 and 30 days before check-in will receive a 50% refund for all nights.
• No Refund: Cancellations made less than 7 days before check-in are non-refundable.

10. PEST CONTROL & WILDLIFE DISCLOSURE:
Due to the subtropical climate of Texas, guests may occasionally encounter common pests such as American cockroaches (commonly known as “tree roaches”), insects, mosquitoes, or other wildlife typical to the region. This is a normal occurrence in Texas properties and is not indicative of poor housekeeping or property conditions.

11. HURRICANES, TROPICAL STORMS & INCLEMENT WEATHER:
This property is located in a coastal area where hurricanes, tropical storms, flooding, heavy rain, high tides, Red Tide, and other severe weather events may occur. Weather conditions are unpredictable and are outside of the Host’s control.

No refunds, credits, date changes, or cancellations will be provided due to hurricanes, tropical storms, tropical depressions, mandatory or voluntary evacuations, road conditions, power outages, flooding, beach erosion, inclement weather, or any other weather-related event unless otherwise required by applicable law.

12. UTILITIES:
Power, internet, water, cable, and other utility services are provided by third-party utility companies and service providers. While every effort is made to maintain these services, the Host has no control over outages, interruptions, equipment failures, weather-related disruptions, or utility company repairs.

No refunds, credits, discounts, or cancellations will be provided for interruptions to electrical service, internet, cable, water, or other utilities that are outside of the Host’s control.

13. HOT TUB:
The hot tub is professionally cleaned, sanitized, and balanced prior to your arrival. To ensure it remains clean, safe, and available for all guests, before and after pictures are taken prior to and after your stay. By signing this agreement, you agree to the following rules:

Maximum Occupancy: No more than 8 people may be in the hot tub at any time.

Use at Your Own Risk: Use of the hot tub is at your own risk. The Host assumes no liability for injuries, illness, accidents, or death resulting from the use or misuse of the hot tub. Children must be supervised by an adult at all times.

No refunds, credits, or discounts will be issued because the hot tub is unavailable, temporarily out of service, or has not yet reached the desired temperature due to a drain and refill, required maintenance, or circumstances beyond the Host’s control.


14. MAIN ACCESS ROAD:
The main access road to the property runs alongside the beach and is frequently covered with sand. Road conditions can become difficult or impassable during periods of rain, storms, high tides, or other weather events.

15. PARKING:
You may park up to 5 vehicles in the driveway. Additional parking is permitted on the grassy area to the left of the tree. Do not block the driveways or access roads of neighboring properties at any time.

18. ITEMS LEFT BEHIND / RETURN OF ITEMS
To have an item returned, the guest must request it in writing within the 14-day window. A $50 handling fee plus the actual cost of postage applies to all returns and is due before the item ships.
