License Agreement Terms and Conditions
In accordance with the local laws, community rules and regulations Guest acknowledges and agrees that this is:
License Agreement Only: When a guest agrees to make a reservation the guest agrees that the guest enters into a license agreement to go on the property and enters into an expressed license agreement between the Host and Guest. No rental agreement is entered by making a reservation. No fee is received for the issuance of the license. No fee is received to enter into the license agreement. No lease agreement is entered by making the reservation to go on the property.
No Lease or Rental Agreement Created. This Agreement grants the Guest a limited, and revocable license agreement between Host and Guest to go on the Property. The licensee may not use, may not occupy and may not reside at the property. License Agreement does not grant or create any lease, tenancy, transient or other interest or estate in real property. No tenant landlord relationship is implied or expressed in this agreement.
No Possessory Interest: The Guest has no right of possession, no leasehold, and no landlord-tenant relationship with the Host. The Guest acquires no rights under any landlord-tenant, housing, or similar statutes.
Revocable at Will: The Host may revoke this license, with or without cause, at any time and in the Host’s sole discretion. Upon revocation, the Guest must immediately vacate the Property.
The property is not a transient lodging establishment, not a public lodging establishment a but a single family residential property. The property is not a hotel, motel, non-transient apartment, transient apartment, bed and breakfast inn, timeshare project, or vacation rental.
No Residency: Licensee shall not change their ID or mailing address to this property.
Non-Exclusive: The Guest’s right to go on the Property is non-exclusive. The Host, and others authorized by the Host, may enter and use the Property at any time. The Guest does not have the right to exclude the Host, or anyone authorized by the Host.The license is non-exclusive, and host licensor retains unrestricted access to the Property at all times with advance notice to enter the Property.
The license agreement is non-transferable.
The license agreement is revocable at hosts discretion.
The license agreement grants personal permission to go on the property only as a social guest.
The online terms are posted on this advertisement are incorporated into the license agreement.
The license agreement does not grant the licensee the right to reside at the Property.
The license agreement grants a personal privilege to access the Property.
The license agreement does not grant interest in the land of the Property.
The license agreement does not grant possession of the estate therein of the Property.
No unregistered guests after 10 pm.
Guests cannot block traffic in the neighborhood and cannot block other properties driveways or mailboxes.
No party speakers can be used at the property after 9 pm.
Term of License Agreement: The license granted herein shall commence on the date of execution of this Agreement and shall continue for a period of no less than six (6) months and no more than ten (10) months in duration, unless earlier terminated in accordance with the provisions set forth herein.
Availability, and Conditions: The license is subject to applicable availability, and other terms and conditions as may be determined by the Licensor from time to time. The Licensee acknowledges and agrees to comply with all such terms and conditions as may be communicated by the Licensor.
In accordance with the local laws, community rules and regulations: Violations of Association rules and covenants will automatically revoke the license agreement.
NO WEDDINGS, this is a residential area and we cannot accommodate weddings at this home.
Consideration: Consideration for the issuance of the license is intangible and is solely the satisfaction of hosting social guests at the property. No consideration is given in order to enter the license agreement. Any fees that are received are exclusively used to facilitate the issuance of a license. The person that is making a reservation enters into a license agreement between the host and guest to stay at the property as a non paying social guest.
Residency and Transiency: No guest shall reside at the property and shall not make the home their residence. The Guest shall not use, reside, or occupy the property. No transient relationship is expressed or implied in making the reservation to be a non paying social guest at this home. Additional fees received may be paid to a third party in order the maintain and prepare the property. No compensation is received for the use and/or stay at the property.The license agreement does not grant transiency. No transient agreement is expressed or implied by entering into the license agreement.
Termination: The Licensor reserves the right to terminate this license at its sole discretion, with or without cause, upon providing written notice to the Licensee. Upon termination, the Licensee shall immediately leave the licensed property and return any materials or documentation provided by the Licensor.
Host’s Right of Entry: The Host reserves the unrestricted right to enter the Property at any time, for any purpose, with reasonable prior notice.
Nuisance: The home is subject to a strict no noise policy after 10pm. Exterior noise emanating from within dwelling or other improvements including without limitation, talking, singing, television, radio, cell phone, speaker, shall be maintained at such a volume that the noise is not audible beyond the boundaries of the Lot or Building Plot from 11:00 pm to 7:00 am. Any Guest deemed to be in violation of this policy shall have their license revoked and will be required to vacate the property.
Acknowledgment: By proceeding with this reservation, the Guest expressly acknowledges and agrees that this Agreement creates only a license agreement, not a lease or tenancy, not a transient use or transient occupancy and that the Host retains full legal possession and control of the Property at all times. The person that is making a reservation obtains a license to go onto and stay at the property as a non paying social guest. No rental agreement is entered by making a reservation. No transient agreement is expressed or implied and the guest agrees to be a non paying social guest at this home. The guest and any guests present at the property are non-transient guests.
